PARTNER PORTAL – TERMS OF USE

1.Introduction

The Partner Portal is an information and ordering platform owned by INOXPA SAU (NIF A17778390) with registered address at C/ Telers 60, 17820, Banyoles (Spain), henceforth “the Company”. INOXPA SAU is the parent of the companies listed at https://www.inoxpa.com/nota-legal

2.Terms of use

These terms of use govern access to and the use of the Portal.

It is not an online sales portal; it is a platform for information and placing orders.

The Portal is for the exclusive use of customers registered in the Company’s database, henceforth “Users”. The User accesses the Portal using an ID and password provided by the Company and will be responsible for the custody thereof.

In order to use the services and information provided, the User must read and accept these terms of use when accessing the Portal for the first time.

Prior to setting the User up on our system, the terms of the contract between INOXPA and the customer (payment conditions and methods, delivery options, etc), must be separately agreed. This must be completed before any access is given access to the Portal.

The User is responsible for confirming the orders, which can be accessed using the ID and password provided. Nevertheless, an order placed by the customer is not treated as a firm order until an official sales confirmation has been issued by the Company.

The stock availability figures on the Portal are for guidance only, and the sales confirmation document will include details of the delivery date of each item.

The total order weight refers to the net weight excluding packaging and pallets.

The delivery charge shown when the order is entered is based on the entire order being transported as a single shipment. If the customer opts for partial deliveries of the order, although a single delivery charge is shown, INOXPA reserves the right to charge for delivery for each shipment.

The customer has the option to save orders on the Portal for a certain period of time. Prices may change during this period and the final price will only be confirmed when the order is completed.

There is an option allowing the customer to specify when the items are to be delivered, subject to final confirmation by INOXPA.

3.Liability

The User agrees to comply with these terms at all times. The User must use the Portal with care and accepts liability for any failure to comply with the rules of use.

Except where there is legislation to the contrary, and only to the extent provided for in said legislation, the Company does not guarantee against or assume any responsibility for possible damages caused by the use of the information, data and services of the Portal. 

4.Modifications

The Company reserves the right to modify these terms of use of the Portal. The User is recommended to regularly consult these terms of use.

5.Intellectual and industrial property

All the content, brands, logos, technical and/or marketing documentation, IT programs and any other aspect that may be protected under intellectual and industrial property legislation and which may be accessed via the Portal are the exclusive property of the Company, which expressly reserves all rights thereto. The creation of hypertext links to any item featured in the Portal’s website pages is forbidden without prior authorisation by the Company.

The use of the Portal does not confer to the User any licence or usage authorisation regarding content, data or services other than those expressly detailed in these terms of use.

6.Notifications

All notifications, requirements, requests and other communications that the User wishes to send to the Company must be submitted in writing via the Portal. Reception will be confirmed when the User receives a copy via the e-mail address indicated in their profile on the Portal.

7.Applicable legislation and competent jurisdiction

These terms are governed by and interpreted in accordance with the legislation applicable in the country where the selling Company has its registered offices. All claims must be presented before the courts of the city and/or country where the corresponding INOXPA company has its offices.
